GENERAL TERMS AND CONDITIONS OF SALES

Note: The english version of this contract is not binding and is only applicable for information purposes. The French contract will be applicable in case of any dispuet or conflict.

INFINITY CYCLES distributes bicycles, electric bicycles and branded accessories via the Internet and via points of sale located in France. These General Terms and Conditions of Sale apply to legal transactions relating to products marketed to its customers by INFINITY CYCLES within its virtual shop on the Internet.

ARTICLE 1 - PRICE

1.1 The prices of our products are indicated in euros all taxes included, excluding the cost of processing and shipping. (See shipping / deadlines and costs).

1.2 All orders regardless of their origin are payable in euros.

1.3 Infinity Cycles reserves the right to modify its prices at any time but the products will be invoiced on the basis of the rates in force at the time of the recording of the orders subject to availability on this date.

1.4 The products remain the property of Infinity Cycles until full payment by Infinity Cycles.

Contractual information is presented in French and will be the subject of a confirmation containing this contractual information at the latest at the time of delivery. Infinity Cycles reserves the right to cancel or refuse any order from a customer with whom there is a dispute over the payment of a previous order.

ARTICLE 3 - VALIDATION

You declare that you have read and accepted these Terms and Conditions of Sale before placing your order. The validation of your order is therefore acceptance of these Terms and Conditions of Sale.
Unless proven otherwise, the data recorded by is the proof of all transactions made by Infinity Cycles and its customers.

ARTICLE 4 - AVAILABILITY

Our product offers and prices are valid as long as they are visible on the site, while stocks last. Our product offers are offered within the limits of available stocks.
This information comes directly from our suppliers, errors or modifications may exceptionally exist. In the event of unavailability of product after placing your order we will notify you by mail or phone as soon as possible. Your order will be cancelled once Infinity Cycles has agreed with the customer the automatic refund or additional time for receiving the product.
For payment by cheque, in case of unavailability of all or part of the order, the refund will be made by return of cheque sent in payment.

ARTICLE 5 - DELIVERY

The products are delivered to the delivery address you specified during the ordering process. In the case of items that are deliverable at different dates, given their availability, Infinity Cycles reserves the right to split deliveries. Participation in processing and shipping costs will only be charged for one shipment. The Infinity Cycles can not be held responsible for the consequences due to a delay of routing. In case of payment by credit card, the indicated deadlines are average times and correspond to the time of treatment and the delivery for the products destined to Metropolitan France and Monaco. In the case of split deliveries, only the products shipped are debited. In case of payment by check, the order will be processed upon receipt of the check. As a result, special offers may no longer be available.

ARTICLE 6 - PAYMENT

The payment of your purchases is made:

• Via SECURED INTERNET credit cards: Visa, MasterCard or other Blue Cards. www.aix-bike-velo.com has adopted the SSL encryption process to protect all data related to personal information and means of payment.

• either by MAIL with bank cheque or CB (credit card or debit card). In case of payment by cheque, it must be issued by a bank domiciled in France. The cashing of the cheque is made upon receipt of the cheque. The cheque will be sent to Infinity Cycles 373 Jean Paul Coste Avenue, 13100 Aix-en-Provence, accompanied by a copy of the order. The processing of the order occurs upon receipt of payment.

ARTICLE 7 - REIMBURSEMENT

Refunds of products in the cases referred to in Articles 5 and 8 shall be made within a period of 30 days or less after the receipt of the products by us. The refund will be made by credit to your bank account via the secure SSL transaction. No return of goods against payment will be accepted for whatever reason.

ARTICLE 8 - RETURN OR REFUNDED

8.1 You have a period of 15 days from receipt to return the product that does not suit you. The costs of sending and return will be your responsibility. Only the price of the products purchased will be refunded. Returns are to be made to Infinity Cycles 373 Jean Paul Ave Coste, 13100 Aix-en-Provence in their original packaging, complete (accessories, instructions) in good condition, and accompanied by a copy of the invoice.

8.2 The right of return can not be exercised for audio or video recordings unsealed by the Customer. Items returned incomplete, damaged, damaged or soiled by the Customer are not included.

As such and in accordance with the provisions of the Code of Intellectual Property, only the use is authorized for private use subject to different or even more restrictive provisions of the Code of Intellectual Property. 11.2 Certain products such as DVDs are the subject of personal and specific rights of use to regulate copies, public distribution, rental. ARTICLE 13 - GUARANTEE

Products purchased on Infinity Cycles are eligible for the manufacturer's warranty. In order to know the steps to follow concerning the after sales service for any problem or breakdown on a product you can contact customer service.
To be able to benefit from the guarantee of the products it is imperative to keep the invoice of purchase of the product.
The contractual guarantees do not cover:

1. the replacement of consumables (batteries, bulbs, fuses, wheels, bearings, buckles, screws).

2. abnormal or improper use of the products. We invite you to read the instructions for use included with the products carefully.

3. The defects and their consequences related to the use not in conformity with the use for which the product is intended (professional, collective use).

4. defects and their consequences related to any external cause.

However, in any case you benefit from the provisions of the legal warranty including those relating to the guarantee of hidden defects.

ARTICLE 14 - APPLICABLE LAW / DISPUTES

This agreement is subject to French law. In case of dispute the court of Aix-en-Provence will be the only competent.

Infinity Cycles agrees not to disclose to third parties the information you provide. These are confidential. GENERAL RENTAL CONDITIONS

ARTICLE 1:

The bicycles and accessories, at all time, remain the exclusive property of AIX BIKE AND GO. You accept full responsibility for the care of this equipment and are responsible for its damage or loss. You have 30 minutes from the beginning of the use of the equipment to report any malfunction, after which all repairs needed as a result of the use of the equipment will be attributed to you and may be subject to additional charges.

ARTICLE 2:

The equipment is used at your own risk. You will release AIX BIKE AND GO of all liability in the case of injuries or damages to the user(s) of the equipment or to any other person or property. You agree not to make a claim against AIX BIKE AND GO for injuries or damages relating to bicycling or the use of this equipment.

ARTICLE 3:

In case of theft or accident, you must contact AIX BIKE AND GO immediately, make a declaration to the local police and submit a copy to AIX BIKE AND GO.

ARTICLE 4:

You have the option to subscribe an anti-theft guarantee. This guarantee only applies in case of theft and upon submission of the police declaration referred to above. An excess payment may be required depending on the level of coverage selected. The guarantee does not cover for damages incurred during the time of rental. ARTICLE 5:

It is forbidden to modify or carry out major repairs to the bicycles, to sub-rent or lend the bicycles, to carry a passenger other than an infant in a designated child seat.

ARTICLE 6:

Our bikes are equipped with a chain lock that you shall use at all times when parking the bicycle. It is mandatory to attach the frame of the bike to a fixed object that cannot be moved or removed.

ARTICLE 7:

You authorize AIX BIKE AND GO to use your credit card information to pay for the rental and to cover for potential damages and/or loss of the bike(s).

ARTICLE 8:

The rental agreement terminates upon return of the bikes and after verification of their condition by a AIX BIKE AND GO agent.

ARTICLE 9:

For each rental we ask for a deposit. This deposit will be taken by credit card imprint. Therefore, nothing will be debited or blocked.

ARTICLE 10:

You have until 24hours before the start of your rental to inform AIX BIKE AND GO about any changes concerning your booking. Once you have entered the rental agreement, you will not be able to shorten the rental dates. If you wish to extend your rental, please contact your AIX BIKE AND GO shop in order to see if the bikes you have rented are still available.
Please be aware that AIX BIKE AND GO does not refund in case of anticipated returns. If you bring the bikes back before the end date of your booking, you will lose any benefits of special offers if you no longer meet the conditions.

ARTICLE 11:

All disputes arising in connection with the rental agreement shall be settled by the courts of Aix-en-Provence, France.
